These Terms of Service ("Terms") govern your access to and use of the Bitnex Crestfort platform (the "Platform") operated through the domain bitnex-crestfort-platform.com ("we," "us," or "our"). You agree to notify us immediately of any unauthorized access or use of your account. We reserve the right to suspend or terminate accounts that provide false, inaccurate, or misleading information.

4. Platform Services

Bitnex Crestfort provides a technology platform that facilitates cryptocurrency trading and digital asset management. Our services include access to market data, trading tools, order execution interfaces, portfolio tracking, and custody solutions. The Platform is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted, timely, secure, or error-free operation of the Platform. We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time without prior notice.

5. Trading Risks and Disclaimers

Cryptocurrency trading involves substantial risk of loss. The value of digital assets is highly volatile and can fluctuate significantly over short periods. Past performance is not indicative of future results. You acknowledge and accept that you may lose some or all of your invested capital. We do not provide investment advice, financial planning, tax advice, or legal counsel. You are solely responsible for evaluating the risks and merits of any trading decision. 6. Prohibited Activities

You agree not to engage in any of the following prohibited activities: (a) violating any applicable laws, regulations, or third-party rights; (b) engaging in market manipulation, fraud, or deceptive practices; (c) using the Platform for money laundering, terrorist financing, or other illicit activities; (d) attempting to gain unauthorized access to our systems or other users' accounts; (e) interfering with or disrupting the integrity or performance of the Platform; (f) using automated systems or software to extract data from the Platform without our express written permission; (g) impersonating any person or entity or misrepresenting your affiliation with any person or entity; or (h) transmitting viruses, malware, or other harmful code.

7. Intellectual Property

All content, features, and functionality of the Platform, including but not limited to text, graphics, logos, icons, images, software, and data compilations, are the exclusive property of Bitnex Crestfort or our licensors and are protected by international copyright, trademark, patent, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal or internal business purposes in accordance with these Terms. You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any material from the Platform without our prior written consent.

8. Fees and Payments

Use of certain Platform features may be subject to fees, including but not limited to trading commissions, withdrawal fees, and subscription charges. All applicable fees will be clearly disclosed to you prior to execution of transactions or activation of paid services. You authorize us to deduct applicable fees from your account balance. We reserve the right to modify our fee structure at any time upon reasonable notice. You are responsible for all taxes associated with your use of the Platform and your trading activities.

9. Termination

We reserve the right to suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice, including for violation of these Terms, suspected fraudulent or illegal activity, or for any other reason at our sole discretion. Upon termination, your right to use the Platform will immediately cease. You may terminate your account at any time by following the account closure procedures outlined in your account settings. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity obligations, and limitations of liability.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Bitnex Crestfort, its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from: (a) your access to or use of or inability to access or use the Platform; (b) any conduct or content of any third party on the Platform; (c) unauthorized access, use, or alteration of your transmissions or content; or (d) any trading losses or investment decisions made based on information obtained through the Platform. In no event shall our total aggregate liability exceed the amount of fees paid by you to us in the twelve months preceding the event giving rise to the claim, or one hundred euros (€100), whichever is greater.

11. Indemnification

You agree to defend, indemnify, and hold harmless Bitnex Crestfort and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) any trading activities conducted through your account.

12. Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms or your use of the Platform shall first be subject to good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through the competent courts or arbitration in accordance with applicable law. These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which you reside, without regard to conflict of law principles.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Platform and updating the "Last Updated" date. Your continued use of the Platform following the posting of revised Terms constitutes your acceptance of such changes. We encourage you to review these Terms periodically.

14. General Provisions

These Terms constitute the entire agreement between you and Bitnex Crestfort regarding the use of the Platform. If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction. These Terms do not create any third-party beneficiary rights.
